NEW DELHI: A total of 52 petitions in a category relating to “habeas corpus issues” are pending in the Supreme Court on December 13, Lok Sabha was informed on Friday.
Generally speaking, a habeas corpus remedy is a writ used to challenge a person’s unlawful detention or imprisonment and is intended to protect fundamental rights.
Responding to a question on the number of habeas corpus appeals pending before the Supreme Court and higher courts to date, Law Minister Kiren Rijiju explained in a written response that the information is not being kept in the Supreme Court as requested.
However, he shared the number of pending cases, according to the Supreme Court Subject Category Code 1300 which relates to “habeas corpus cases” at the Supreme Court, as taken from the Integrated System of business management information (ICMIS).
The Minister said that at the end of 2020, 53 such cases were pending before the highest court and 40 at the end of 2019. At the end of 2018, 43 such cases fell under the category relating to “ habeas corpus cases ”were pending in court. upper court.
Referring to the high courts, he said that as of December 14, 108 habeas corpus cases were pending in the Bombay High Court.
Likewise, up to December 9, 35 such cases were pending before the High Court of Gauhati. In the High Court of Kerala, 24 such cases were pending as of December 10, and in the High Court of Madhya Pradesh, 97 habeas corpus cases were pending as of December 1.
