Criminal Court “C” summoned Patrick Sudue, Inspector General of Police, Montserrado County District Attorney, and others for the alleged detention of a suspect identified as Joe Young beyond the constitutional time limit (48 hours).
The subpoena of Judge T. Ciapha Carey is also the result of the alleged failure of the aforementioned individuals to honor a precedent writ of “Habeas Corpus” issued by this honorable court to have the Inspector General and his co-associates in this case. to return Joe to his attorney as instructed.
The January 19, 2022, Magistrate’s Court “C” Judge ordered the appearance of Inspector General Sudue, Special Assistant to the Inspector General of Police, County Attorney and others to appear before him on Thursday, January 20, 2022 at 10 a.m. hours to show tangible cause why they cannot be held in criminal contempt for their refusal to honor the writ of habeas corpus served by this court.
Judge Carey in his summons noted that Col. Sudue and the others were served with the filing of the writ of habeas corpus by attorney for the suspect Joe Young, Cllr. Momodu Kandakai ordered them to hand over Joe to his client, but they neglected to honor that court order.
The court considers that such action by Sudue and others not to comply with his instructions hampers the functions of this honorable court and subjects it to public ridicule, hence the issuance of the subpoena.
